If my child has been bitten and the case is worth more than $25,000 do I have to set-up a Conservatorship?

A: Yes.  If your child's damages exceed $25,000, it is very unlikely that an insurance company will require that you obtain court approval of any settlement.  This is because Iowa law requires a Conservatorship to be opened if the settlement or verdict for a minor child exceeds $25,000.  You could try to open a Conservatorship on your own, but there are many specific legal requirements that must be followed.  The better practice would be to talk to an attorney before agreeing to any settlement terms with the insurance company to determine if the settlement is reasonable and if a Conservatorship is needed.
