Leveling the Field between Injured Iowans and Insurance Companies.

What are the most and least amounts of Iowa Workers' Comp benefits for which I am eligible?

A: When your Iowa Workers' Comp benefits are computed, they're based on 80% of your weekly spendable earnings. There is, however, a maximum allowable weekly rate based on the type of benefits you qualify for, which a Des Moines work injury law firm can explain to you in detail.

Maximum Iowa Workers' Comp Benefits

The maximum allowable benefits you can receive in a week for Total Temporary Disability, Healing Period benefits, Permanent Total Disability, or death benefits amounts to $1457.00. For Permanent Partial Disability, the total weekly maximum rate is $1340.00.

Minimum Iowa Workers' Comp Benefits

For Total Temporary Disability and Healing Period benefits, your minimum amount is equal to the lesser of either:

  • your weekly benefit amount, when your gross earnings per week are 35% of the statewide average; or
  • your spendable weekly earnings.

For Permanent Partial Disability, Permanent Total Disability or death benefits, your minimum benefits will be the same as the weekly benefit amount of a person whose gross earnings per week are 35% of the statewide average for a weekly wage.

The average weekly wage statewide is $728.29, which means that 35% of that wage amounts to $255.00.

A lot of factors are considered when computing your gross weekly earnings, and there are several methods that the law allows for in order to figure the amount of Iowa Workers' Comp benefits.

It can be difficult to digest all of Iowa's Division of Workers' Compensation's stipulations, and it's a good idea to contact a Des Moines work injury law firm to make sure you have a firm understanding of all your Workers' Comp rights.
