What if the injuries were caused by an employee of another company?

 

A: If you can prove that an employee or another company was negligent and the negligence caused the injuries then there is compensation available for the damages sustained.  This means in addition to the workers' compensation claim, you may be able to recover additional damages against the other employee and/or the company that he/she worked for when you were injured.  Iowa construction injury cases can be very complicated and you will almost certainly need an attorney to deal with the various legal issues which can include contracts with indemnity provisions, subrogation, etc.  Subrogation means that if you make a recovery for injuries that you received workers' compensation benefits for then you will likely have to pay the workers' compensation insurance company back for what they have paid.  However, there are exceptions for comparative fault that you are assessed, loss of consortium damages and your attorney fees and pro-rata costs in pursuing the claim for personal injuries.
