How Much Should I Tell the Insurance Adjuster?

It is likely that if you have been injured in a car accident or other personal injury accident that an insurance adjuster will be contacting you about your case. They may ask you to "answer a few questions", "to give a recorded statement" and/or to “sign a few forms”. It is almost never a good idea to give an insurance company a recorded statement. Before you agree to give a recorded statement you should ask the insurance adjuster the following:

1. Will they allow you or your representative to take a recorded statement of their insured?
2. Will they put in writing that you are not at fault for the accident and that their insured is at fault having their insured sign the statement?
3. Will they give you copies of all written or recorded statements the insurance adjuster takes from witness?
4. Will they put in writing the amount of available insurance coverage they have for their insured including all secondary or umbrella policies?
5. Will they put in writing the amount of the "reserve" they have placed on your case?
6. If you agree to sign their medical release (generally not recommended) will they put in writing that they will send you a copy of every record they get with the release?
7. Will they put in writing, whether they have performed any surveillance or an investigation of you and if yes, will they provide you a copy of the videos, reports or pictures?
