Leveling the Field between Injured Iowans and Insurance Companies.

Was your last text message worth the risk of getting into a car accident? People text at all times of the day, including the time spent driving.

Drivers encounter many distractions on the road, when drivers use their cells phones they increase their risk of being involved in an accident. There are 16 states and the District of Columbia that have banned texting while driving. There are 6 states that have banned the use of cell phones while driving. Cell phone use has become very popular over the last few years; people are texting more than ever. Texting has gone from about 10 billion messages a month in December 2005 to more than 110 billion in December 2008 according to CTIA, the cellular phone industry’s trade group.

Are you a frequent texter?
Clearly people are texting at all times of the day, including times when they are behind the wheel. Texting can be one of the most distracting things to do while you are driving. Law makers are worried that there won’t be enough evidence to know whether or not a person was texting while driving, especially if they cause an accident, but there have already been major crashes within the last year that were caused due to the driver text messaging and later admitting that they were texting while driving.

Do you think Iowa should pass this ban? Surely you have seen more than your share of people talking or using their cell phone while driving down the road. If you happen to encounter one of these drivers, it would be wise for you to get away from them as quickly as possible. Texting or using your cell phone while driving may not be worth the harm it can cause. There are certain things you can do to prevent these types of distractions:

• Put your cell phone on silent so you won’t be tempted to answer calls or texts
• Use speed dial so you don’t have to type in a bunch of different numbers
• If you must make or take a call, keep the conversation short
• Ask a passenger to help
• Pull over to use your phone if possible
• Do Not take calls during heavy traffic or bad weather

Unfortunately you or someone you know may be involved in a car accident where the other person was using their cell phone while driving. This can be devastating to you and your family. People need to be aware of how dangerous this kind of driving behavior is. If you have any questions or concerns, the attorneys at Walker, Billingsley & Bair are here to help answer your questions.
