We have almost made it through the holiday season which can be a lot of fun and a time to see family and friends. Most likely the weather either snowed you in with your family and friends or prevented you from seeing them. Just because Christmas is over doesn’t mean there won’t be a lot of traffic out on the roads. This time of year can be very deadly with weather conditions alone causing hazardous situations for drivers, throw in a bottle of booze and that’s a recipe for disaster. New Year’s Eve and New Year’s Day is coming up this week which can mean even more travel for many Iowans. During the last week the Midwest, including Iowa has seen a lot of snow and ice. Due to all the dangerous road conditions there have been at least 19 fatalities nationwide, if not more.

If you are planning a night out with your friends or family for New Year’s Eve you need to have a plan before you head out for the night. If you know where you and your friends are going and who is driving it can make your night much safer. You should never decide who is going to drive home at the end of the night. If you know you will be drinking you should make plans for someone sober to give you a ride home even if your plans are to drink at a friend’s instead of going out, you should plan to stay the night to avoid all dangerous situations on the road.

You can put yourself and others in danger even if you plan to only drink a few. You can become impaired enough to affect the simplest driving tasks even after you have only had one or two drinks.

Under Iowa law a person is "intoxicated," if, by drinking beer, wine, or liquor, one or more of the following is true:
1. [His] [Her] reason or mental ability has been affected.
2. [His] [Her] judgment is impaired.
3. [His] [Her] emotions are visibly excited.
4. [He] [She] has, to any extent, lost control of bodily actions.

Evidence of a person's blood-alcohol level, if available, is important evidence of intoxication. This is usually only available if the intoxicated person was arrested for drunk driving, public intoxication, assault, etc. During New Year’s Eve the roads are generally under close patrol, because many people bring in the New Year by having cocktails with friends or family which is why having a sober driver could keep you out of jail and even save your life.

There are going to be many different New Year’s Eve events going on which means there could be a lot of traffic in your town. If you aren’t able to find a sober friend, maybe you can arrange a plan with someone in your family can come get you or if a cab service is available we suggest you use it rather than trying to drive. There have already been a lot of accidents due to the snow and ice, if you get someone who is impaired behind the wheel on a snowy or icy road than it the situation could be very deadly.
