Don't let the insurance company talk you into a settlement without considering your injuries and future medical care

When you are involved in a car accident the other driver’s insurance company will most likely call you as soon as they receive information regarding the accident. In the beginning most of the adjusters sound like they genuinely care and are being reasonable with you, however, more than likely they are just trying to settle your claim for the lowest amount possible without taking your injuries into further consideration. A lot of insurance companies are training the adjusters to be more aggressive to help save their company money; if they can get your claim settled quickly for a low amount they are happy, but down the road you might not be if you need further treatment.

If you are injured there is a good chance that your injuries will fully develop over the next couple days following your accident, which is why you should take plenty of time before making a decision. If you take an offer from the insurance company without going to the doctor or making sure your injuries aren’t going to cause you any future problems you can’t go back after the insurance company to pay more medical bills once the case has been settled.

You should generally wait to settle your case until your treating physician has placed you at maximum medical improvement or MMI or you have fully recovered. Once your attorney has all your medical records they will go through to measure the extent of your injuries and figure out how or if you have been limited from your daily activities due to the accident. A demand letter will be sent to the insurance adjuster, which is usually a very high offer of what you will accept for settlement which starts the negotiating process.

Going through treatment and following your doctors’ orders can make your case worth more if you have been seriously injured. It might be tempting to just take the amount the insurance company is offering to settle, but you should make sure that future medical care that you will need is taken into consideration as well.
