Do You Really Need An Attorney in Your Case?

You definitely do not need an attorney for every injury case. For example, we will give you some examples as they involve different types of cases:

Workers’ Compensation

  • Cases involving scheduled member only injuries such as fingers, hands, arms, legs and eyes. Our experience is that many injured workers can handle their own scheduled member injury cases. Therefore, we believe that our time is better spent helping those with other cases. However, if your injury originally started as a scheduled member injury and you have been diagnosed with a mental health condition, CRPS- Chronic Regional Pain Syndrome, RSD- Reflex Sympathetic Dystrophy or other body as a whole condition then you will probably need an attorney. Also, if you previously have sustained a scheduled member injury (whether it is from a work related injury or not) then you may qualify for the Iowa 2nd Injury Fund which may provide you with additional benefits.   • If you are done treating for an unscheduled member injury such as your back, shoulder, neck or brain injury and you have returned to your job making the same wages and you do not have either a permanent impairment rating or permanent restrictions. If this is the case, then your industrial disability, if any, is probably low and you can try to handle the case on your own.

Car and Motorcycle Accident

  • If you are done treating and you have less than $5,000 in total “hard damages” also known as “special” damages. Please keep in mind this is not just out of pocket expenses such as co-pays and deductibles, these include the “total” medical charges including total past and future medical bills and/or past and future lost wages.

Dog Bite

  • Cases involving minor injuries such as no permanent injuries or scars.


Why would we not handle these cases?


First of all, in small cases the attorney fee and costs might leave little or nothing for you after your medical bills are paid which would not be fair to you. Also, these cases would take time away from the more significant cases that we handle. For example, if you are fired and have been hurt at work there is a right and wrong time to apply for unemployment benefits. You need an attorney that can also help you through the unemployment process because it can have a significant impact upon your injury claim). The earlier you hire a qualified attorney to help you, the less likely that you will make a mistake that could cost you thousands of dollars. Keep in mind that if you are currently receiving weekly benefits, the attorney you hire should not take any percentage of your current benefits and most will not require you to pay a retainer or any up-front fees.

Permanent Injury- If it did not appear that your injuries were serious at first, but after you are done treating you receive a permanent impairment rating and/or permanent restrictions or if you still have ongoing pain or limitations then you should talk to a qualified injury attorney to find-out if you should receive compensation for your permanent injuries and in workers' compensation cases to find out if you should receive Second Injury Fund benefits.
