Four Important Time Requirements to Not Hurt Your Iowa Work Injury Claim

Iowans who suffer from a work-related accident and injury have certain time restrictions that they face when they seek workers’ compensation pay.

Notice of Injury: Workers have 90 days to supply their employer with notice that they have experienced a work-related accident and injury. The 90-day period begins when the employee knew or should have known about the injury. If employees miss this 90-day window, then they could be denied their workers’ compensation pay.

Reporting of Claims: Employers have to file a First Report of Injury within four days from the time that their employees notify them that they were hurt at work. Employers have to file this report with the workers’ compensation commissioner when employees experience any accident and injury causing them to miss three or more days at work or when employee are permanently disabled or killed on the job.

Two-year Statute of Limitation: Employees have two years from the onset of their injury to file for arbitration with the workers’ compensation commissioner. If the employee does not receive benefits but waits more than two years to file for arbitration, then the employee could be denied benefits.

Three-year Statute of Limitation: If employees receive workers compensation pay for their accident and injury but feel they are entitled to more, then they have three years from the last payment of weekly benefits to file an action before the workers compensation commissioner. This statute of limitation does not apply, however, to medical expenses necessary for treating the injury.
