If your workers' compensation claim has been denied then the workers' compensation insurance company will not pay for future medical bills. After representing hundreds of injured workers since 1997, attorney Corey J. L. Walker reveals his opinions about how to best deal with medical bills.

If the workers' compensation insurance company denies your claim, then they will not pay for your medical care and treatment. However, they are required under Iowa law to pay the medical bills for any medical care that they directed under Iowa Code § 85.27. The workers' compensation insurance company should send you a denial letter that you will need to keep. You will likely need to provide a copy of the letter to your health insurance company so they will pay your medical bills. If workers' compensation denies your bills, then your health insurance company is required to pay for them under Iowa Code § 85.38 which provides:

If an employer denies liability under this chapter . . . for payment for any medical services received by an employee with a disability, and the employee is a beneficiary under either an individual or group plan for non-occupational illness, injury, or disability, the non-occupational plan SHALL NOT deny payment for the medical services on the basis that the employer's liability for the medical services under this chapter . . . is unresolved. (Emphasis added).

Keep in mind that just because your workers' compensation claim has been denied does not mean that you do not have a case. While your claim is being disputed, here are some of the different sources to submit your medical bills for payment:

1. Your own health insurance from your employment benefits package.

2. Your own health insurance that you may have paid for personally.

3. Health insurance obtained by your spouse for your benefit or by your parents if you are under age and living with such parents.

4. Medicaid and Iowa Cares- If you are not covered under an insurance plan you may be eligible for one of these insurance programs. You should contact your local Department of Human Services to find-out. If you do qualify for one of these programs it is very important that you notify me so that their claim can be timely submitted for repayment.

5. Your own personal funds if you were not insured and are able to pay medical bills as they are incurred.
