Leveling the Field between Injured Iowans and Insurance Companies.

Are You Being Paid the Right Amount?

If you have been hurt on the job your injuries may qualify for weekly benefits from your employer. If so, the amount you receive for your weekly workers’ compensation benefits is based on your average weekly wages which is your weekly income (not including extra pay for overtime) before taxes. You will then receive 80% of your spendable earnings based on your average weekly wages. This is usually a little less that you normally take home after taxes.

There are certain factors that need to be taken into consideration when the insurance company calculates your rate such as marital status, exemptions, whether you are full-time or part-time, etc. Any one of these factors could throw your rate off causing you to not be paid the correct amount. If you have a workers’ compensation case it is important that you talk to an attorney about your weekly rate. Even if your weekly benefit checks are only off by $20 or $30 dollars, it could add up over a period time and the insurance company would need to pay you the difference, plus 10% interest. Our attorneys at Walker, Billingsley & Bair have seen many workers’ compensation cases where the employee is being under paid by their employer’s insurance company.
