The amount of your payments or "weekly benefits" is dependent on your average earnings before your injury (average weekly wage, or AWW). If you are paid hourly, your rate will be determined by your average wage for 13 full-time weeks before your injury. Your rate will also be based on your marital status, the number of exemptions you have, and your AWW multiplied by 80% of your weekly spendable earnings.
If you are permanently disabled, you are eligible for cash benefits. The amount of your benefits is dependent upon the body parts affected, previous injuries, the extent of the disability, and the average weekly earnings before the injury occurred.
Once you have reached your maximum medical improvement (MMI), you are entitled to an independent medical exam by a medical provider of your choosing.
By law, your employer is prohibited from terminating your employment because you filed a Workers' Compensation claim. You can be fired for work problems, absences, or other unrelated reasons. Also, with only a few exceptions (such as being a union member), your employer is not obligated to find you new employment if you are unable to return to work.
Receiving Workers' Compensation benefits does not mean you are obligated to stay with the same employer, although leaving during your treatment may affect your claim.
You can petition for alternative medical services if the medical care provided to you by your employer and/or their insurance provider is inadequate. If your employer denies liability in your case, however, this petition will be dismissed.
