Why have my workers' compensation checks stopped?

One of the most common reasons that Iowans hurt at work call an attorney is because their weekly checks have stopped.  Most people want to know if they can just stop their check with no reason.  There are several reasons that the workers compensation insurance company may have stopped paying you weekly checks.  Sometimes, the insurance adjuster has made a mistake and not set-up your checks to be sent automatically each week.  If this is the case, a phone call can often solve the problem and get the checks restarted.  Other times there may be a legal reason that they have stopped paying you.
Here are some of the common legal reasons that Iowa workers compensation insurance companies stop paying you your weekly checks:
1. You have returned to work and do not have a permanent injury.  (Note: You are  allowed a 2nd opinion under Iowa law if the company doctor says you do not have a  permanent impairment rating).
2. You have been paid the entire permanent impairment rating.  (Note: There are many circumstances in which the insurance company owes you more than just the impairment rating.)
3. The insurance company has denied your Iowa workers compensation claim.
4. The insurance company has sent you a 30 day Auxier notice describing why they are stopping your benefits.
5. You have failed to attend an 85.39 medical examination.
6. The company doctor has released you to return to work and you do not report for work.
7. You no longer work for the same employer and the company doctor releases you to return to work with restrictions and your former employer indicates that they can accommodate the restrictions.

If you do not think one of the legal reasons apply, it is important to contact the adjustor as soon as possible to get an explanation of the problem.  If you have anymore questions regarding your workers' compensation weekly checks or your claim in general, our attorneys at Walker, Billingsley & Bair are here to help answer any of your questions and concerns you may be having.
