If you are thinking about creating a will or have been appointed as an executor, it is normal to feel uncertain about the next steps. Many people ask questions such as:

  • Do I need a will and what happens to my assets if I die without one?
  • What is the difference between a will and a living will?
  • Why should I have a power of attorney and what responsibilities does that person have?
  • Does my loved one’s estate need to go through probate?
  • How much does it cost and how long does probate take?

Understanding Probate

Probate is the court process used to transfer assets to heirs after a death. This is done according to the deceased person’s will, or under state law when no will exists. A full probate action can be costly and time consuming. Fees are paid to the executor or administrator and to the attorney handling the estate. In most cases, assets are not distributed for six to twelve months, and complicated estates can take even longer.

Planning to Avoid Probate

Thoughtful planning before death may help avoid a full probate action. Several options include:

  • Creating a living trust, which allows assets to pass directly to beneficiaries without court involvement.
  • Using a will with a minor’s trust for smaller estates, which may allow summary probate proceedings.
  • Changing how property is titled, which can reduce the assets that must pass through probate.

Our office provides complete wills, estate planning, and probate services, along with other related legal assistance.
