Iowa law has very strict time deadlines for you to file suit, serve the defendants and provide notice or make claims for different types of actions. These time limitations can be as short as six months from the date of injury to provide written notice to a bar in a DRAM shop case. A DRAM shop case is when a person is injured because of a intoxicated person who was over served or served while intoxicated at a bar. The general rule in Iowa is that you have to file a lawsuit within two years from the date of the injury accident, except in some cases involving minors, and where notice of the injury is an issue. The failure to act timely to protect yourself can completely eliminate your right to recovery. You should consult an attorney to find out what the time limitations are in your particular case. And you should never wait until the last minute to try and resolve your case. In fact, we do not accept cases in which there is less than three months before the statute of limitations will expire.
