As you probably realize, insurance companies would rather keep their money, then pay your claim. So if they can find a way to deny your case they will. Sometimes this means denying that they're insured was at fault or other times they will attempt to place blame upon you for the accident, which is called comparative fault under Iowa Law, if you are 50% at fault or less, then you can make recovery for your damages, but your damages are reduced by your percentage of fall. For example, if you have $1 in damages, and are found to be 25% at fault, then you will only receive 75 cents because your damages are reduced by the 25% or 25 cents. Keep in mind that just because the insurance company has denied your claim, does not necessarily mean they are right. If your claim has been denied, do not just give up, but rather you should speak with a qualified personal injury attorney to determine if it is worth pursuing your claim. Further, we provide consultations for deny claims at no cost or obligation to you.
